Abstract:

Problematika rozhodčího řízení ve sportovním prostředí je v rámci českého akademického juristického prostředí z hlediska publikační činnosti oblastí velmi málo zpracovanou, a to přes tu skutečnost, že je to právě rozhodčí řízení, které je dominantním způsobem řešení sporů ve sportovním prostředí, a jednotlivé orgány pro řešení sporů v tomto ve značné míře nahrazují činnost obecných soudů. Stejně jako sportovní právo, respektive otázka jeho (ne)existence jakožto samostatného právního odvětví ve smyslu práva heteronomního, tak stojí i problematika rozhodčího řízení ve sportovní prostředí spíše na okraji zájmu akademického juristického prostředí. S ohledem na shora uvedené autor této práce věnuje pozornost jednak problematice právní úpravy, jakož i praktického fungování rozhodčího řízení ve sportovním prostředí, a to zejména v rámci České republiky, a jednak problematickým aspektům, která v sobě skýtá v obecné rovině tato a současně i jednotlivé konkrétní úpravy v rámci jednotlivých národních sportovních odvětvích. Vzhledem k tomu, že nejen sport jako takový, ale též rozhodčí řízení, respektive arbitráž není fenomén toliko národní bude závěr práce jednak věnován komparaci rozhodčího řízení ve vybraných sportovních odvětvích v České republice a Slovenské republice, a jednak způsobu řešení sporů na nadnárodní úrovni, in concreto řízením před FIFA Dispute Resolution Chamber a Court of Arbiration of Sport.

Abstract:

The arbitration or dispute resolution chambers in the sports environment is not in high interest of Czech academic floor in terms of publishing activities, despite the fact that it is the arbitration that is the dominant method of dispute resolution in the sports environment and the arbitration bodies replaces the function of courts. The existence of sports law and the issue of arbitration in sporting environments is rather marginalized by the interest of the academic juristic environment. With regard to the above-mentioned, attention is paid both to the legal regulation and to the practical functioning of arbitration in the sports environment, especially within the Czech Republic, and to the problematic aspects that this and at the same time individual specific adjustments within each national sport sector. On behalf of conclusion, that arbitration is not our national phenomenon, the thesis is devoted to the comparison of arbitration in selected sports in the Czech Republic and Slovak Republic and the way of dispute resolution at transnational level, in concreto proceedings before the FIFA Dispute Resolution Chamber and the Court of Arbiration of Sport.
