Abstract:

Diplomová práce se zabývá seznámením s Rámcovým rozhodnutím Rady o Evropském zatýkacím rozkazu a postupech předávání mezi jednotlivými členskými státy, přijatém v červnu 2002. Dále pak kroky vedoucími k jeho přijetí na úrovni zemí Evropské unie a České republiky, analýzou nálezu Ústavního soudu České republiky, který se Evropským zatýkacím rozkazem zabýval, popisem institucí, které ho využívají, přehledem významných změn, které se s tímto opatřením zavedly a rozborem případů z praxe, dotčených tímto rámcovým rozhodnutím. Přestože se téma dotýká všech občanů Evropské unie, není i přes svou značnou důležitost širší veřejnosti dostatečně známo. Cílem práce je seznámení s celou problematikou spojenou s Evropským zatýkacím rozkazem v širším úhlu pohledu. Dílčím cílem je poukázat na problémy provázející implementaci v zemích Evropské unie a České republice, osvětlení kroků vedoucích k jeho přijetí, rozbor případů z praxe. Hlavní otázkou je zjištění, zda rámcové rozhodnutí není v rozporu s ústavním pořádkem České republiky.

Abstract:

The thesis focuses on familiarization with the Framework Decision on the European arrest warrant and the surrender procedures between Member States adopted in June 2002. It also describes steps leading to its adoption by the European Union and the Czech Republic and analysis of the Constitutional Court of the Czech Republic who has dealt with the European arrest warrant. Thesis also includes description of institutions that use the European arrest warrant, an overview of significant changes that were introduced and analysis of cases that were affected by the Framework Decision. The goal of the thesis is familiarization with all issues associated with the European arrest warrant in a broader perspective. Secondary objective is to highlight the issues accompanying the implementation in countries of the European Union and the Czech Republic, to clarify steps leading to its adoption and analysis of particular cases. The main task is to determine whether the Framework Decision is not in conflict with the constitutional law of the Czech Republic. The aim of the thesis was achieved as it has been proven in accordance with the decision of the Constitutional Court of the Czech Republic that the European arrest warrant is not in conflict with the constitutional law and does not violate the Constitution.
