Abstract:

Tato práce se zabývá procesními aspekty žaloby na neplatnost se zaměřením zejména na otázky přípustnosti. Ty jsou důkladně analyzovány a jsou diskutovány klíčové otázky, přičemž je uvedeno několik možných řešení. Značná pozornost je věnována pojmu "napadnutelný akt", neboť tento pojem představuje ústřední bod sporu o neplatnost a v současné době je dále rozvíjen Evropským soudním dvorem. Rozebráno je rovněž řízení před soudem, přičemž je poukázáno na vybrané aspekty řízení o žalobě na neplatnost. Závěrečná část uzavírá pojednáním o účincích rozhodnutí ve věci a případných dopadech zrušení aktu na vnitrostátní právo a navazující akty.

Abstract:

This thesis deals with the procedural aspects of an action for annulment, focusing in particular on issues of admissibility. These are thoroughly analysed and the key issues are discussed, with several possible solutions presented. Good amount of focus is dedicated to the concept of "challengeable act", as this represents a centerpiece of the annulment litigation and is currently being developed further by the European Court of Justice. The procedure before the court is also discussed, pointing out chosen aspects of the annulment action procedure. The final section concludes with a discussion of the effects of the decision in the case and the possible implications of the annulment of the act on national law and subsequent acts.
