Unfair competition in terms of economic competition

Abstract:

Bakalářská práce se zabývá problematikou nekalosoutěžního jednání v České republice. Tato problematika je zajímavá a aktuální, protože hospodářská soutěž předpokládá nejenom etické a správné jednání všech soutěžitelů, ale také nekalosoutěžní praktiky, které jsou protiprávní. Cílem této práce je na příkladu soudních sporů určit, kdy se jedná o nekalou soutěž a kdy nikoliv, a jakými prostředky se může soutěžitel bránit proti nekalosoutěžnímu jednání. Pro dosažení cíle práce bude použita především metoda literární rešerši, analýza odborných zdrojů a literatury a právních předpisů, které upravují oblast nekalosoutěžního jednání. Významnou částí práce je analýza judikátů – rozsudků Nejvyššího správního soudu a také usnesení a rozhodnutí Rady pro reklamu. Dále bude použita metoda syntézy a dedukce, sjednocování všech zjištění pro vyvození relevantních závěrů v práci. Výstupem této bakalářské práce je zhodnocení právní úpravy nekalosoutěžního jednání v České republice, vymezení hlavních kategorií nekalosoutěžního jednání a také postihů za nekalosoutěžní jednání v České republice. V práci budou též uvedeny příklady, kdy navzdory zdánlivosti nekalosoutěžního jednání soutěžitel neporušil pravidla hospodářské soutěže a mohl ve své činnosti a nabídce svých výrobků pokračovat.

Abstract:

The bachelor's thesis deals with the issue of unfair competition in the Czech Republic. This issue is interesting and topical, because competition presupposes not only the ethical and correct conduct of all competitors, but also unfair competition practices that are illegal. The aim of this work is to determine, on the example of litigation, when it is an unfair competition and when it is not, and by what means a competitor can defend himself against unfair competition. In order to achieve the aim of the work, the method of literary research, analysis of professional sources and literature and legal regulations that regulate the area of unfair competition will be used. An important part of the work is the analysis of case law – judgments of the Supreme Administrative Court, as well as resolutions and decisions of the Advertising Council. Furthermore, the method of synthesis and deduction will be used, unifying all findings to draw relevant conclusions at work. The output of this bachelor's thesis is an evaluation of the legal regulation of unfair competition in the Czech Republic, the definition of the main categories of unfair competition and sanctions for unfair competition in the Czech Republic. The work will also include examples where, despite the appearance of unfair competition, the competitor did not violate the competition rules and could continue in its activities and offer its products.
