Unreasonable length of judicial proceedings in practice of the Constitutional Court of the Czech Republic and the Council of Europe Strasbourg

Abstract:

Tato práce začíná přiblížením pojmu spravedlivého procesu, v rámci kterého je uvedena i samotná úprava nepřiměřené délky jak v Listině základních práv a svobod, tak v Evropské úmluvě o ochraně lidských práv a základních svobod. Dále se práce zabývá již samotnou nepřiměřenou délkou v judikatuře Ústavního soudu České republiky a v judikatuře Evropského soudu pro lidská práva. Poté následuje porovnání rozdílnosti samotných délek dle jednotlivých typů soudních řízení. Nakonec jsou řešeny důsledky nepřiměřené délky soudního řízení a možné varianty jejího řešení de lege ferenda, a to jak z pohledu účastníků řízení, tak i z pohledu státu.

Abstract:

This thesis begins with an explanation of the concept of due process, within which the actual regulation of inadequate length is stated both in the Charter of Fundamental Rights and Freedoms, as well as in the European Convention for the Protection of Human Rights and Fundamental Freedoms. Following that the thesis deals with the actual unreasonable time in the judgments of the Constitutional Court of the Czech Republic and in the judgments of the European Court for Human Rights. Subsequently, there is a comparison of differences in individual times according to specific types of judicial proceedings. In the end, the consequences of unreasonable time of judicial proceedings, as well as possible options of its solution de lege ferenda, both from the perspective of the parties to the proceedings, as well as from the perspective of the government are dealt with.
