Legal Aspects of Hacking

Abstract:

The thesis deals with hacking, particularly with regard to its social and legal aspects. Initially discussing the historical development of the terms hacking and hacker, the hacker community development and media misinformation. Next the author deals with definitions of hacker, its relationship to the definition norms of cyberspace, the principles of the hacker ethic, and from its perspective there is a division into different types of hackers. Then the basic model phases of hacker attacks with examples of specific activities are presented. Finally, the author deals with relation between the law and cyberspace, and in particular the law in regard to hacking from the perspectives of criminal law, the civil law or the laws dealing with intelligence services. The thesis also outlined some of the legal forms of hacking activities.

Abstract:

Diplomová práca sa zaoberá hackingom, obzvlášť s ohľadom na jeho spoločenské a právne aspekty. Spočiatku je rozoberaný historický vývoj ohľadom pojmov hacking a hacker, vývoj v hackerskej komunite a mediálne dezinformácie. Ďalej sú riešené otázky definície hackera, jeho vzťah k definičným normám kyberpriestoru, princípy hackerskej etiky, a na základe nej dochádza k deleniu na rozličné druhy hackerov. Sú predstavené i základné modelové fázy hackerského útoku s príkladmi konkrétnych aktivít. Napokon sú riešené otázka práva vo vzťahu ku kyberpriestoru, a zvlášť právne askekty hackingu z pohľadu trestného práva, odvetví civilného práva, či práva spravodajských služieb. Sú načrtnuté i niektoré legálne formy hackerských aktivít.
