Emergence and Disappearance, Rights and Obligations of Members in Accordance with Law

Abstract:

Annotation TECÁKOVÁ, Helena, Mgr.: The emergence and disappearance of membership, the rights and obligations of members of the cooperative in accordance with the commercial code. [Bachelor Thesis]. Banking Institute University Praha, foreign University Banská Bystrica. Department of economics, valuation, social sciences and law. Supervisor: doc. JUDr. Juraj Špirko, CSc. Year of the submission: 2013. Sites: 52. The work is devoted to the most important issues of the field of business - legally. The first part was devoted to the elaboration of the theoretical background of the field, the history - the legal dimension of cooperatives and regulatory history of the idea of cooperatives, the first entity and the founder to the concept of law and consequently their critical evaluation and comparison. Subsequently, attention will be paid to the basic definitions of concepts, principles and values of the national and international perspective. In connection with the accession to the EU and the developing international cooperation, especially between firms and cooperatives explaining some European and international aspects. The next part is devoted to a consideration of the establishment of cooperatives. In the penultimate part of this work we analyze the rights and obligations of members and membership associations. The last part is focused on extinction and abolition team.

Anotácia TECÁKOVÁ, Helena, Mgr.: Vznik a zánik členstva, práva a povinnosti členov družstva podľa Obchodného zákonníka. [Bakalárska práca]. Bankovní institut vysoká škola Praha, zahraničná vysoká škola Banská Bystrica. Katedra ekonómie, oceňovania, spoločenských vied a práva. Vedúci práce: doc. JUDr. Juraj Špirko, CSc. Rok obhajoby: 2013. Počet strán: 52. Práca je venovaná najdôležitejším otázkam riešenej problematiky z obchodno - právneho hľadiska. Prvá časť práce bola venovaná rozpracovaniu teoretických východísk riešenej problematiky, historicko - právnej dimenzie vzniku družstiev a právnej úpravy, história myšlienky družstevníctva, prvým subjektom a ich zakladateľom až po koncepcie právnej úpravy a následne ich kritické zhodnotenie a porovnanie. Následne na to bude venovaná pozornosť aj základným definíciám jednotlivých pojmov, princípom a hodnotám z národného a medzinárodného hľadiska. V súvislosti so vstupom SR do EÚ a stále sa rozvíjajúcou medzinárodnou spoluprácou najmä medzi obchodnými spoločnosťami a družstvami bolo potrebné vysvetliť aj niektoré európske a medzinárodné hľadiská. V ďalšej časti práce sa venuje pozornosť vzniku a založeniu členstva. V predposlednej časti práce je rozpracovaná analýza práv a povinnosti členov. Posledná časť práce je zameraná na zánik členstva.
