Alternative dispute resolution in business relations

Abstract:

Práce popisuje metody alternativní řešení sporů, a to převážně v případě obchodních vztahů. Obchodní vztahy zanikají hlavně z důvodu nevyřešených sporů, které v takovémto vztahu vznikají. Dalším důvodem zaniknutí obchodního vztahu může být výsledek sporu řešeného soudním řízením, který nedovoluje vztahu stran dále pokračovat. Práce je rozdělena do šesti kapitol v teoretické části, po které následuje část praktická. Prvotně je v práci charakterizováno fungování obchodního vztahu, další kapitola řeší charakteristiku alternativního řešení sporů. Třetí kapitola popisuje právní úpravy pro Českou republiku. Další kapitola charakterizuje jednotlivé druhy mimosoudních metod. Následující dvě kapitoly jsou věnovány dvěma nejčastěji využívaným metodám, které jsou od sebe velmi odlišné. Pátá kapitola se věnuje pouze mediaci a jejímu průběhu, a to včetně dohod, které se k mediaci vztahují. Další kapitola popisuje rozhodčí řízení, jeho charakteristiku a proces. Poslední část diplomové práce je věnována praktické části, která ukazuje využití zmíněných metod na praktických příkladech. Tyto praktické příklady jsou zhodnocené a zodpovídají otázky, které jsou položené hned v úvodu diplomové práce. Hypotézy byly potvrzeny také na základě dotazníkového šetření.

Abstract:

The thesis describes methods of alternative dispute resolution, mainly in business relations. Business relations cease to exist because of unresolved disputes that arise in such a relationship. An outcome of a litigation settled by the court, that does not allow the business relationship to be continued, may be another reason for the termination of the business relationship of the parties. This thesis is divided into six chapters of the theoretical part, followed by the practical part. Initially, the functioning of a business relationship is described, followed by a description of an alternative dispute solution in the next chapter.The third chapter describes legal specifics for the Czech Republic. The next chapter describes different kinds of out-of-court methods. The following two chapters are dedicated to two of the most used methods, that are very different from each other. The fifth chapter focuses on mediation and agreements, that come along with it. The next chapter describes arbritration, its characteristics and process. The last part of the thesis is dedicated to the practical part, that point out the use of the described methods in real examples. These examples are evaluated, and bring answers to questions asked in the beginning of the thesis. Hypothesis were confirmed based on the results of a survey.
