Fragmentation of International Public Law Through Proliferation of International Judicial Bodies

Abstract:

Práce se primárně věnuje otázce vzájemné souvislosti fragmentace a proliferace. Zabývá se otázkou zda, do jaké míry a jakým způsobem dochází k fragmentaci mezinárodního práva prostřednictvím proliferace soudních orgánů. Sekundárně se práce zaměřuje na přiblížení teoretické debaty týkající se zkoumaných jevů a poukazuje na otázky, které značně komplikují vyslovení jakýchkoliv definitivních a prakticky aplikovatelných závěrů. Práce dovozuje, že proliferace přispívá k fragmentaci. Míru této podmíněnosti ale nelze jednoznačně určit. Fragmentace totiž – na rozdíl od proliferace - není skutečností objektivní. Jedná se o kategorii normativní. To, zda určitý jev (např. proliferaci) označíme za projev fragmentace, totiž závisí na našich představách o ideální a žádoucí podobě mezinárodního právního systému. V teorii přitom v současnosti neexistuje shoda o žádoucí podobě mezinárodního právního systému. Jednotlivé kapitoly se věnují definici obou zkoumaných jevů, jejich vzájemnému vztahu, konkrétním příkladům z praxe a také možným řešením a reakcím. Práce dovozuje, že za současného stavu jsou to především samotní soudci mezinráodních tribunálů, kteří významně ovlivní to, do jaké míry se obavy z fragmentace prostřednictvím proliferace naplní.

Abstract:

This thesis primarily analyses the interrelationship of fragmentation and proliferation. It addresses the question whether, to what extent and how does the proliferation of judicial bodies cause the fragmentation of international law. Secondly, the paper focuses on the theoretical debate about given phenomena and highlights the issues that complicate any definite and practically applicable conclusions. The thesis concludes that the proliferation contributes to fragmentation. Nevertheless, the degree of this conditionality cannot be clearly determined. Unlike the proliferation, the Fragmentation is not an objective fact. It is a normative category. Whether a particular phenomenon (eg. proliferation) is perceived as an indication of fragmentation depends on our perceptions of ideal and desirable form of international legal system. Yet, there is currently no theoretical consensus on the desirable form of international legal system. Individual chapters of the thesis deal with the definition of two phenomena to be investigated, their mutual relationship, practical examples of the given issues and also with possible solutions and responses. The thesis concludes that it is primarily the judges of international tribunals themselves, who significantly affect the extent to which the fear of fragmentation through the proliferation will be filled.
