Property Right Over the Property of Another Person

Abstract:

The Bachelor thesis focuses on the analysis of rights that one holds against others property. The first chapter is devoted to the theoretical definition of the concepts of rights in rem, their division and centre of a problem. The second part of the work gradually discusses all three kinds of rights in rem, which are: lien, real burden an tax lien. Due to the extensiveness of this topic, the largest part of the work is devoted to the lien, as one of the most important safeguarding legal institutes. In an analysis of rights that one holds against others property, we ascertained that all three types of rights that one holds against others property need legislation through the amendment of the Civil Code. Therefore, the third chapter points out the need to recast the use of Civil Code, application of the de lege ferenda, that may occur after the change of laws in the future. This chapter also focuses on comparison with the Czech Civil Code. In connection to the need for recast of the Civil Code, this work furthermore alerts to the lack of the legal institute of submortgage and the legal Institute of the right of construction. The benefit of this work is finding the use of lien, real burden and tax lien in the business practice and alert to the shortcomings of current legislation of these legal institutes.

Abstract:

Bakalárska práca sa zameriava na analýzu vecných práv k cudzím veciam. V prvej kapitole sa venuje teoretickému vymedzeniu pojmov vecné práva, ich podstate a deleniu. V druhej časti práca postupne rozoberá všetky tri druhy vecných práv, ktorými sú záložné právo, vecné bremeno a zádržné právo. Vzhľadom na rozsiahlosť tejto témy, najväčší priestor je venovaný záložnému právu, ako jednému z najvýznamnejších zabezpečovacích právnych inštitútov. Pri analýze vecných práv k cudzím veciam sme zistili, že všetky tri druhy vecných práv k cudzím veciam potrebujú právnu úpravu prostredníctvom novelizácie Občianskeho zákonníka. Preto tretia kapitola poukazuje na potrebu rekodifikácie Občianskeho zákonníka a využitie de lege ferenda, ktorý môže nastať po zmene zákonov v budúcnosti. Táto kapitola je taktiež zameraná na komparáciu s českým Občianskym kódexom. V súvislosti s potrebou rekodifikácie OZ, táto práca ďalej upozorňuje na požiadavku doplnenia chýbajúceho právneho inštitútu podzáložné právo a právneho inštitútu právo stavby. Prínosom tejto práce je zistenie využitia záložného práva, vecného bremena a zádržného práva v podnikateľskej praxi a upozornenie na nedostatky súčasnej právnej úpravy týchto právnych inštitútov.
