Law Stages of Law Application Procedure

Abstract:

Tématem mé bakalářské práce jsou stadia aplikačního procesu. V úvodní části práce jsem vymezil aplikaci páva jako prostředek k regulaci společenských vztahů, určil její místo v právním systému a vymezil samotný pojem aplikace práva. Ve druhé části práce jsem se zabýval jednotlivými stadii aplikačního procesu, zjištění skutkového stavu, nalezení příslušné právní normy, kde jsem věnoval pozornost pojmu interpretace práva a vydání individuálního právního aktu. V závěru mé práce jsem se věnoval druhům rozhodnutí v trestním řízení, jež jsem chtěl demonstrovat jako praktické příklady aktů aplikace práva a základním zásadám trestního řízení.

Abstract:

The topic of my thesis is the stages of the application process. In the introductory part of the thesis I defined law application as a mean to regulate social relations; I established its place in the legal system and defined the very concept of application of the law. In the second part I dealt with the various stages of the application process, finding the facts, finding the relevant legal standards, where I paid attention to the concept of law interpretation and the issue of an individual law act. At the end of my thesis I was devoted to the types of decisions in criminal proceedings, which I wanted to demonstrate as practical examples of law application acts and fundamental principles of criminal procedure.
