Judicial decision in judicial civil proceedings

Abstract:

Annotation The Bachelor thesis deals with the court decisions in the civil proceedings in consideration of their types and essential elements. The aim of this work is theoretical treatment of the applicable legislation of adjudication, resolution, payment order, certificate of inheritance and measures as kinds of judicial decisions in general, and an indroduction of the basic concepts regarding the decisions in the civil proceedings. The bachelor thesis is comprised of one theoretical part which is divided into six chapters. This part is focused on the general characteristics, nature and importance of the judicial decisions.In this work the issues of particular kinds of the judicial decisions are specified and discussed. It is started with the description of adjudication and further continued with the explanation of the resolution and draught. The payment order is subdivided into the groups of european payment order, order to meet and paper payment order. Another part of the bachelor thesis deals with the certificate of inheritance and measures as kinds or forms of judicial decisions which are used in the cases specifically provided. In the final part ofthis work the an Institute of the validity and enforceability of judgments is covered and explained.

Anotácia Bakalárska práca sa venuje súdnym rozhodnutiam v občianskom súdnom konaní so zreteľom na ich druhy a podstatné náležitosti. Cieľom práce je teoretické spracovanie platnej právnej úpravy rozsudku, uznesenia, platobného rozkazu, osvedčenia o dedičstve a opatrenia ako druhov súdnych rozhodnutí zo všeobecnej stránky, uvádzanie základných pojmov týkajúcich sa týchto rozhodnutí v občianskom súdnom konaní. Bakalársku prácu tvorí jedna teoretická časť, ktorá je rozdelená do šiestich kapitol. Zameraná je na všeobecnú charakteristiku súdneho rozhodnutia, na jeho podstatu a význam. Práca bližšie špecifikuje a rozoberá problematiku jednotlivých druhov súdnych rozhodnutí. Ako prvý opisuje rozsudok, ďalej sa venuje uzneseniu a platobnému rozkazu. Platobný rozkaz člení na európsky platobný rozkaz, rozkaz na plnenie a zmenkový (šekový) platobný rozkaz. Súčasťou bakalárskej práce je aj osvedčenie o dedičstve a opatrenie posudzované ako druhy resp. formy súdneho rozhodnutia, ktoré sa využívajú v špecificky ustanovených prípadoch. Napokon v závere práca objasňuje inštitút právoplatnosti a vykonateľnosti súdnych rozhodnutí.
