Possession (according to the new Civil Code)

Abstract:

Cílem práce je systematický a srozumitelný výklad problematiky spojené s držbou. Práce je rozdělena do několika kapitol, které pojednávají o konkrétních oblastech právní úpravy obsahující držbu jako takovou a v nich je obsažen nejprve malý exkurz do minulosti (vývoj soukromého práva a držby od římského práva do současnosti), obecné vymezení pojmu držba a dále je pozornost věnována jednotlivým ustanovením, kterými je upravena držba v NOZ (od nabytí držby, přes specifikaci jejích jednotlivých aspektů (dělení), ochranu držby a její zachování, až po její zánik).

Abstract:

The objective of the dissertation is a systematic and understandable interpretation of questions connected with the possession. The dissertation is divided into several chapters dealing with concrete fields of the legal framework of the possession itself as a whole and containing, first, a brief excursion into the past (the evolution of the private law and possession since the legal system of the Ancient Rome till our days), the general definition of the term "possession", plus, moreover, the attention is paid to the individual provisions governing the possession in the the new Civil Code (NOZ), [ie. starting with the acquisition of the possession, followed by the specification of its individual aspects (division), protection of the possession and its preservation, as far as to its extinction].
