Instruction and the informed Consent of the Patient

Abstract:

Již více než 40 let je institut informovaného souhlasu součástí českého(před rokem 1993 československého) právního řádu. Nicméně, i přes svoje zakotvení v zákoně, uspokojivě používán nebyl. Podnětem pro změnu bylo přijetí Úmluvy o biomedicíně, obsahující úpravu práv pacientů, v roce 2001. Mezi tato práva bezpochyby patří i právo jednotlivce se svobodně rozhodovat v otázkách péče o vlastní zdraví. Projevem tohoto práva je pak institut informovaného souhlasu, který je předmětem této práce, a který vyjadřuje pravidlo, že nikdo nesmí být nucen podstoupit jakýkoli zákrok, aniž by k tomu dal svůj souhlas, tedy aniž by se o podstoupení či nepodstoupení zákroku svobodně rozhodl. O aktuálnosti tématu svědčí i úprava informovaného souhlasu v návrhu občanského zákoníku, stejně jako ve věcných záměrech zákonů upravujících oblast zdravotnictví, které vznikly v rámci právě probíhající reformy zdravotnictví.

Abstract:

Although an informed consent is a part of our system of law for more than forty years, it was not sufficiently apllied. Ratification of the Convention on Human rights and Biomedicine was an impulse to change it. The Convention i.a. determine that an intervetion in the health field may only be carried out after the person concerned has given free and informed consent to it. This rule makes clear patient's autonomy in their relationship with doctors and restrains the paternalist approaches which might ignore the wish of the patient. Nowadays some subject-matters of law were created as a part of the reform of health services which is proceeding now. One of them is concerned with health services and involves regulation of most problems which are related to the informed consent. At the same time an informed consent is regulated in a bill of Civil code. This legislator's interest shows us how actual this subject is.
