Geographical indication and designation of origin in viticulture

Abstract:

Předmětem této bakalářské práce je užívání zeměpisného označení a označení původu jako jednoho z prvků ochrany vína. Cílem této práce je posouzení snadnosti vymáhání práv plynoucích z označení původu a zeměpisného označení po rozboru vybraných soudních sporů a po komparaci práv vyplývajících z těchto označení s právní úpravou EU a USA navrhnout případná možná zlepšení ochrany. Součástí práce je průzkum vnímání těchto označení spotřebiteli i výrobci vína v České republice a zjištění, jakou pro ně mají tato označení hodnotu.

Abstract:

The subject of this bachelor thesis is the use of geographical indications and designations of origin as one of the elements of wine protection. The aim of this work is to assess the ease of enforcement of rights arising from designation of origin and geographical indication after analysis of selected litigation and after comparing the rights arising from designation of origin and geographical indication with EU and US legislation to suggest possible improvements in protection. Part of the work is a survey of the perception of designation of origin and geographical indication by consumers and wine producers in the Czech Republic and determining what value they attach to them.
