Competition Policy in the Czech Republic

Abstract:

Diplomová práce s názvem „Politika hospodářské soutěže v ČR“ ve své první části obsahuje analýzu základních ekonomických koncepcí hospodářské soutěže s ohledem na jejich doporučení pro soutěžní politiku státu a upozorňuje na různé cíle, které může politika hospodářské soutěže sledovat a které také ovlivňují její praktickou aplikaci. Práce obsahuje krátký historický exkurs vývoje soutěžního práva v České republice a současně evropského soutěžního práva, které má významný vliv na podobu soutěžního práva národního. Stanovení soutěžních pravidel je ve výlučné pravomoci EU, protože politika ochrany hospodářské soutěže je vnímána jako jeden z jejích nejvýznamnějších nástrojů pro podporu integrace společného trhu. Následná část práce je věnována praktické ukázce v posunu pojetí soutěžního práva směrem k tzv. více ekonomickému přístupu a to prostřednictvím institutu relevantního trhu a jeho stanovení za pomocí SSNIP testu. Na základě toho je kriticky analyzováno využití kvantitativních metod a uvažováno o vzniku možných zdrojů neefektivit v soutěžní praxi, kterou může nesprávné použití SSNIP testu přinést.

Abstract:

The thesis titled „Competition policy in the Czech Republic” contains in the first part an analysis of basic economic concepts of competition with regard to their recommendations for competition policy of the state, and highlights the different goals which the competition policy can follow and which influence its practical application. The thesis contains a brief historical excursus on the development of the competition law in the Czech Republic and also European competition law which has a significant influence on the form of the national competition law. Determination of the competition rules is the exclusive competence of the European Union, because the policy of competition protection is perceived as one of its most important tools to support the integration of the common market. The subsequent part of the thesis is devoted to the practical demonstration regarding the shift of the competition law approach towards to the so called more economic approach, scilicet by means of the relevant market and its determination using the SSNIP test (small but significant and non-transitory increase in price). On that basis it is critically analyzed using quantitative methods and reasoning about the emergence of possibility sources of inefficiencies in competitive practice that improper use the SSNIP test may bring.
