General Development Plan and Local Referendum

Abstract:

Předmětem bakalářské práce „Územní plán a místní referendum“ je rozbor institutu místního referenda, jako nástroje přímé demokracie v obecné rovině a hodnocení jeho dopadů na případové studii místního referenda v obci Omice, které proběhlo v roce 2008, jako důsledek procesu Územního plánování. V úvodní kapitole specifikuji podrobněji téma práce, cíle, kterých chci ve své práci dosáhnout a též důvod, pro který jsem si toto téma vybral. Další dvě části jsou věnovány obecné charakteristice územních samosprávných celků a problematice územního plánování. Poměrně obsáhlá čtvrtá kapitola je zaměřena na pojmy týkající se místního referenda. Zmiňuji zde ústavní základ právní úpravy referenda, právní úpravu místního referenda, obecná ustanovení místního referenda, jeho platnost, závaznost a soudní ochranu. V páté části je uveden popis výchozí situace v obci Omice, které předcházely vyhlášení místního referenda dne 3.9.2007 a to včetně historie vojenského areálu a možných způsobů řešení jeho využití, což byla problematika, kterou mělo místní referendum obce Omice pomoci vyřešit. Část šestá je již věnována skutečným událostem, které se v obci Omice v průběhu místního referenda odehrály, je zde souhrn výsledků, jejich platnost a závaznost. Závěrečná část práce je souhrnem zejména vlastních výsledků práce, jejichž cílem bylo hodnocení důsledků konkrétních výsledků místního referenda ve vztahu k procesu územního plánování, jejich závaznost a dopad na další život v obci Omice a její rozvoj v dlouhodobějším horizontu.

Abstract:

The topic of this Bachelor´s thesis called “The Spatial Plan and Local Referendum“ is the analysis of local referendum institute as a tool of direct democracy on a general level and the assessment of its impact, using the case study of local referendum in the municipality of Omice that took place in 2008 as a consequence of spatial planning. In the introductory chapter I specified the topic of thesis, the targets I would like to achieve and the reason why I have chosen the topic. Another two chapters are devoted to a general description of local government units spatial planning issues. The relatively extensive fourth chapter is focused on concepts associated with the local referendum. The constitutional basis of referendum legal regulations, general provisions for local referendum, validity, binding character and legal protection of local referendum are mentioned. The fifth chapter describes the initial situation in Omice that had preceded the announcement of local referendum on 3rd September 2007, including the history of a former military zone and suggested ways of its use which in fact was the issue that the referendum was to deal with. The sixth chapter is focused on real events that happened in Omice during the local referendum, gives the summary of referendum results, validity of results and their binding character. In the conclusion to the thesis the results are summarized with the aim to evaluate the consequences of local referendum results in association with the process of spatial planning, the binding character of results and impact on life in Omice and its development in the long-term.
