The first land reform and legislative adjustment of property settlement with churches

Abstract:

Problematika církevních restitucí je vzhledem ke změně vlastnických vztahů mezi státem a církvemi a k finančnímu zatížení státního rozpočtu do budoucna velmi aktuální. Diplomová práce se věnuje zákonodárství, které upravovalo majetkové vztahy mezi státem a církvemi v minulosti. Podrobněji se zaměřuje na legislativu první pozemkové reformy a zákona o majetkovém vyrovnání s církvemi a náboženskými společnostmi, které vedly k rozsáhlé intervenci do vlastnictví půdy. V poslední kapitole dochází ke komparaci obou koncepcí s cílem zjistit, zda není v rozporu úprava církevních restitucí se smyslem úpravy pozemkové reformy po roce 1918. Z porovnání vyplývá, že existuje nesoulad mezi současnou koncepcí a koncepcí prvorepublikové reformy.

Abstract:

Due to the changes in ownership relations between the state and the churches as well as the financial burden on the state budget, the issue of church restitutions is highly relevant for the future. This diploma thesis deals with the legislation that regulated property relations between the state and the churches in the past. It focuses in more detail on the legislation of the first land reform and the law on property settlement with churches and religious communities, which resulted in extensive interventions in land ownership. In the last chapter, there is a comparison of both concepts aiming to find out whether there is any contradiction in the regulation of church restitutions in the sense of the land reform after 1918. From the comparison it follows that there is a discrepancy between the current concept and the concept of the First Republic reform.
