Abstract:

Převážná většina příslušníků Policie České republiky je přesvědčena o nutnosti čestného a kompetentního policejního sboru a důsledně projevuje integritu a odpovědnost při provádění obtížných a nebezpečných úkolů. Nicméně v každé policejní organizaci ve světě se vyskytuje také prvek nepoctivosti, neprofesionality, a dokonce kriminálního jednání. Tato disertační práce se zabývá problematikou trestné činnosti policistů v souvislosti s výkonem pravomocí za účelem získání neoprávněného užitku. Problematika korupce je přitom vnímána jako závažný celospolečenský problém, který může mít závažné důsledky pro fungování demokratického státu. Korupce v policejním prostředí může mít různé příčiny a formy, ale s jistotou můžeme říci, že na ni musíme pohlížet, jako na něco naprosto nepřijatelného, neboť kdo jiný než právě policista by měl být v dnešní demokratické společnosti zárukou vysokého morálního kreditu. V uvedené souvislosti nelze opomenout ani pojem „profesní čest“. Tuto specifickou problematiku můžeme označit za něco dosud dostatečně neprobádaného, neboť téma korupční trestné činnosti příslušníků Policie České republiky nebylo ani v literatuře doposud zpracováno. Chybí zde tak materiál potřebný pro orientaci v dané problematice s návazností na nejproblémovější aspekty včetně výkladu souvisejících hmotněprávních a procesněprávních trestních norem.

Abstract:

Majority of police officers of the Police of the Czech Republic is convinced that it is necessary to have honourable and competent police force. These officers consistently show integrity and responsibility during the execution of difficult and dangerous tasks. However, in every police organization in the world we can find an element of dishonesty, unprofessionalism and even criminal acts. This thesis deals with the issue of criminality of police officers in connection to the execution of powers for a purpose of illegal gain of benefits. The issue of corruption is perceived as serious society-wide problem which can have serious consequences on the democratic state function. Corruption in police environment can have different causes and forms. We can say with certainty that we must see it as something totally unacceptable because who else than police officer should be an assurance of high moral credit in today’s democratic society. In this mentioned connection we cannot omit the concept of “professional honour”. We can label this specific issue as something still unexplored because the topic of corruption crimes of police officer of the Police of the Czech Republic was not yet examined in literature. We miss here a material necessary for the orientation in given issue with the connection to the most problematic aspects including the interpretation of related substantive and procedural criminal law regulations.
