Contract on Loan and its Securing

Abstract:

Při zkoumání tématu smlouvy úvěru a jejím zajištění jsem dospěl k názoru, že právě tento způsob zajištění je velice obecným tématem a v praxi hodně používaným. Mezi nejčastěji používané smlouvy, které řadíme ke smlouvám zajišťovacím je smlouva o spotřebitelském úvěru, kterou náležitě popisuji ve čtvrté kapitole práce. Další neopomenutelnou a hodně používanou smlouvou v praxi je i smlouva o inkasu, která nám v mnohém ulehčuje platební styk. Právě touto smlouvou se banka zavazuje obstarat pro příkazce přijetí plnění určité peněžní pohledávky. Obsáhlou část mé práce je tvoří i takzvaná obecná část s názvem teorie obchodních závazkových vztahů. Důvodem proč zmiňuji i teoretickou část je ten fakt, že čtenáři objasní, jak závazkové vztahy vůbec vznikají, jak se uzavírá smlouva, jaká pro nás plyne odpovědnost za porušení smluvních podmínek a v neposlední řadě také zánik obchodních závazků. Cílem celé práce je nastínit problematiku smlouvy o úvěru a jejím zajištění, ač už formou směnky, či jiných možností zajištění.

Abstract:

When I was examining the topic of the loan agreement and the securing thereof, I reached the view that exactly this method of securing is a very general topic and much used in practice. Among the mostly used agreements which we classify as securing agreements is the consumer loan agreement which I duly describe in Chapter 4 of my work. Another important and often used agreement in practice is also a collection agreement which often makes payments easier to us. It is exactly this agreement with which the bank undertakes to arrange the payment of a certain pecuniary claim on behalf of the payer. The extensive part of my work consists of the so-called general part with the title Theory of Business Obligations. The reason why I am mentioning the theoretical part as well is the fact that it explains to the reader how obligations are actually created, how an agreement is concluded, what responsibility arises to us from the breach of contractual terms and finally the termination of business obligations. The objective of the whole work is to outline the problems of a loan agreement and the securing thereof, whether in the form of a bill of exchange or other possibilities of securing.
