The Historical Development of the President's Position in the Czech Republic

Abstract:

Tato práce se zabývá objasněním především ústavně legislativního vývoje pozice prezidenta republiky na základě historických, politických a společenských událostí, a to od doby habsburské monarchie až po současnost. Zachycuje podstatné okamžiky, které měly sílu ovlivnit tento ústavně legislativní vývoj. Zaznamenává konkrétní ústavní změny, které se týkají volby prezidenta, jeho pravomocí k dalším ústavním orgánům a jeho odpovědnosti. Také se zasazuje tyto pojmy do širšího kontextu v rámci konkrétní ústavy a právě již zmíněných událostí. Jakýmsi odrazovým můstkem pro tuto práci je brána především Ústava z roku 1920. Podstatnou část mojí práce tvoří pohled na současnou právní úpravu postavení prezidenta České republiky. Především se však tato práce zajímá o úpravu ústavní. Detailně rozebírá každý článek z aktuální ústavy z její hlavy třetí týkající se prezidenta. Porovnává tři různé formy vlády a dotýká se otázky přímé volby prezidenta a posílení jeho pravomocí. Práce je zakončena vyzdvižením názorových rozdílů dvou významných státníků, kteří měli tu čest stát v čele České republiky.

Abstract:

This thesis aims primarily to describe legislative and constitutional development of the President of the Republic according to historical, political and social events since the Habsburg monarchy until today. The thesis describes essential moments that were able to influence this legislative and constitutional development. The thesis records particular constitutional changes, that are related to presidential election, his powers to others constitutional bodies and his legal liability. The thesis also contextualizes these concepts in terms of particular constitution and noted events. The starting point for this thesis is mainly 1920 constitution. The most important part of this thesis is insight into present legal form of position of the President of Czech republic. This thesis is mainly interested in constitutional legal form. It thoroughly analyses every article of present constitution in its chapter three, that is related to the President of the Republic. This thesis compares three systems of goverment and covers the question of direct election of the President of the Republic and expanding of his powers. The thesis is concluded by elevation of divergencies of opinions of two important statesmen, that had the honour to be head of Czech republic.
