Abstract:

Práce se zabývá charakteristikou a porovnáním úpravy pracovního práva zákonem č. 65/1965 Sb., tzv. starým zákoníkem práce a zákonem č. 262/2006 Sb., který je jako tzv. nový zákoník práce účinný od 1. 1. 2007. Od té doby byl již několikrát novelizován a v současné době se dostává do popředí zájmu návrh na změny tohoto zákona s předpokládanou účinností od začátku roku 2012. Práce je zaměřena nejen na změny v úpravě pracovněprávních vztahů, ale také na důvody a okolnosti přijetí nového zákoníku práce a jeho novel s důrazem na dopad do aplikační praxe. V této souvislosti je vyslovena hypotéza, že nový kodex je příliš složitý, nejasný a pro většinu uživatelů neskýtá dostatečnou podporu při aplikaci jeho ustanovení. Zároveň je konstatována domněnka, že nový zákoník práce nesplnil očekávání zaměstnavatelů, ale ani zaměstnanců, a zůstal navzdory několika novelizacím málo flexibilní a nepřinesl očekávanou smluvní volnost. Ke komparaci těchto hypotéz s praktickými zkušenostmi jsou mimo jiné využity názory zástupců několika společností. Jejich vyjádření ve velké míře korespondují i s vládními návrhy budoucího vývoje pracovněprávních vztahů, které stejně jako názory zaměstnavatelů, potvrzují uvedenou hypotézu. Diplomová práce se také věnuje historickému i současnému postavení pracovního práva a jeho úloze ve společnosti.

Abstract:

This dissertation deals with the characterisation and comparison of labour legislation by the Law No. 65/1965 Coll., so-called the “old” Labour Code, and by the Law No. 262/2006 Coll. as amended, so-called the “new” Labour Code which is valid as of 1.1.2007. The Law No. 262/2006 Coll. has been amended several times since then and the draft law the force of which is presumed as of the beginning of the year 2012 is of great interest and concern at the present time. The dissertation is focused not only on the changes of the regulation of labour relations but also on the reasons and circumstances of the adoption of the new Labour Code and its amendments with emphasis on the impact to the application practice. In this respect it is stated that the new codex is too complicated and vague and it does not provide a sufficient support to most users by the application of its provisions. At the same time a presumption is stated that the new Labour Code did not meet expectations of both employers and employees and remained inflexible in spite of havening been amended several times and did not bring the expected contractual freedom. To the comparison of these hypotheses with practical experience the opinions of the representatives of several companies were used. These opinions correspond in a large extent to government plans of the future development of labour relations that confirms the mentioned hypothesis similarly. The dissertation describes also the historical and current position of labour law and its role in the society.
