Factual basis of a crime and the role of subject and the relevant aspect

Abstract:

Tato bakalářská práce pojednává o tématu skutkové podstaty trestného činu. Podle mého názoru je tato problematika velice důležitá ať už pro odborníky, tak pro širokou veřejnost. Cílem této práce je přiblížit čtenářům tuto odbornou problematiku, umožnit lepší porozumění. Nejprve vysvětlím základní pojmy, které považuji za nejdůležitější. Poté se budu zabývat skutkovou podstatou jako celku. Vysvětlím pojem a význam skutkové podstaty trestného činu a uvedu dle jakých hledisek ji můžeme třídit. Dále popíšu jednotlivé znaky skutkové podstaty. Podrobněji se zaměřím na subjekt trestného činu a subjektivní stránku trestného činu. Zdůrazním význam subjektivní stránky trestného činu - zavinění a jeho vztah k ostatním znakům. V závěru také zmiňuji otázku snížení trestní odpovědnosti.

Abstract:

This bachelor thesis is about factual basis of a crime. In my opinion, this issue is very important for experts and the general public also. The aim of this work is to introduce readers to this professional issue, to enable better understanding. At first I will explain the basic concepts that I consider the most important. Then I will deal with the factual basis of the crime as a whole. I will explain the concept and importance of the factual basis of the crime and I will state according to what aspects we can classify it. Then I will describe the individual sign of the factual basis of the crime. I will focus in more detail on the subject of the crime and the subjective side of the crime. I will emphasize the importance of the subjective side of the crime - the fault and its relation to other signs. In the end I mention the question of reducing criminal liability.
