Uncertain Concepts of Administrative Law and Their Interpretation

Abstract:

Diplomová práce se věnuje neurčitým pojmům správního práva a jejich výkladu. Cílem této práce je propojit teoretické poznatky s praktickým využitím. První část práce se zabývá vymezením institutu neurčitých právních pojmů a jejich výkladu. Druhá část pojednává o aplikaci neurčitých pojmů správními orgány a dále se věnuje srovnání neurčitých právních pojmů a správního uvážení včetně jejich přezkumu soudem. Třetí část se zabývá výkladem neurčitého pojmu „zřejmý omyl“ včetně relevantní judikatury. Práce vychází z odborné právní literatury, příslušných právních předpisů a judikatury soudů.

Abstract:

This diploma thesis concerns indeterminate terms of the administrative law. The aim of this thesis is to interlink the theoretical knowledge with the practical application. The first part of the thesis aims to define the institue of the indeterminate legal terms and their interpretation. The second part deals with application of indeterminate terms by the administrative bodies and it also compares indeterminate legal terms and administrative considerations, including their reviews by the Courts. The third part concerns with interpretation of the indeterminate term „genuine error“ including relevant Court´s case law. The thesis is based on academic judicial writing, relevant pieces of legislation and Court case law.
