Conditions for the Procedural Use of Evidence of Interception and Recording of Telecommunication

Abstract:

Cílem této diplomové práce bylo podrobně analyzovat institut odposlechu a záznamu telekomunikačního provozu, podmínky jeho nařízení a důkazního použití, stručně poukázat na jeho historický vývoj a zhodnotit jeho dopad do základních lidských práv zaručených ústavním pořádkem. První kapitola práce stručně osvětluje právo na soukromí a jeho jednotlivé složky. Dále je blíže popsáno právo na ochranu důvěrnosti komunikace (listovního tajemství), jeho jednotlivé aspekty, jež pod něj spadají a jakým způsobem do něj odposlech zasahuje. V neposlední řadě je zde vyložena zásada proporcionality ve vztahu k trestnímu řízení a její praktické využívání. V druhé kapitole jsem ve zkratce shrnul legislativní vývoj odposlechu a záznamu telekomunikačního provozu, a to od padesátých let 20. století do současné doby. Třetí kapitola již pojednává o aktuální pozitivně-právní úpravě odposlechu, v rámci níž jsem se zaměřil na podmínky nařízení odposlechu, náležitosti příkazu k odposlechu, na problematiku odposlechu mezi obhájcem a obviněným, stejně jako na problematiku odposlechu komunikace mezi advokátem a jeho klientem. Dále jsem v této kapitole zanalyzoval řízení o přezkumu příkazu k odposlechu a nastínil téma prostorových odposlechů. Poslední kapitola pak pojednává o dokazování. Nejprve je objasněn proces dokazování obecně, načež je pojednáváno o absolutní a relativní neúčinnosti důkazů. Dále se v rámci této kapitoly zamýšlím nad doktrínou plodů z otráveného stromu a její praktickou aplikací. Závěr této kapitoly pak tvoří pojednání o samotném důkazním použití odposlechu a záznamu telekomunikačního provozu.

Abstract:

The objective of this thesis was to analyze in detail the institute of interception and recording of telecommunications, the conditions of its order and evidentiary use, to outline its historical development and to evaluate its impact on the fundamental human rights guaranteed by the constitutional order. The first chapter of the thesis provides a brief explanation of the right to privacy and its individual components. Then, the right to protection of confidentiality of communication (secrecy of letters), its different aspects that fall under it and how interception interferes with it are described in more detail. Last but not least, the principle of proportionality in relation to criminal proceedings and its practical application is explained. In the second chapter I briefly summarize the legislative development of interception and recording of telecommunications traffic, from the 1950s to the present time. The third chapter has already dealt with the current positive legal regulation of interception, in which I have focused on the conditions for ordering interception, the elements of a interception warrant, the issue of interception between the attorney and the accused, as well as the issue of interception of communications between the attorney and his client. In this chapter I also analyze the procedure for reviewing a interception order and outline the topic of spatial interception. The last chapter then discusses the issue of evidentiary procedures. First, the procedure of evidence in general is explained, after which the absolute and relative ineffectiveness of evidence is discussed. Next, this chapter considers the fruit of the poisonous tree doctrine and its practical application. This chapter then concludes with a discussion of the actual evidentiary use of interception and recording of telecommunications.
