Instruments of Landscape Planning vs. Instruments of Monument Preservation – Harmony or Disharmony

Abstract:

Památkové bohatství České republiky představuje ve své posloupnosti a celistvosti mimořádné kulturní a finanční hodnoty. Kulturní památky nám předávají informace o našich předcích, jejich životech a zvycích a vytváří tím spojovací článek mezi minulostí a současností. Ochranu nemovitých památek zajišťují dva zákony, zákon č. 20/1987 Sb., o státní památkové péči a zákon č. 183/2006, o územním plánování a stavebním řádu. Cílem této práce je vyhledání souladů, rozporů a duplicit v těchto zákonech a celkové teoretické zhodnocení legislativního zázemí ochrany nemovitých památek. Práce se zabývá různými pohledy na památkovou péči a územní plánování. V praktické části je na konkrétním příkladu Branického pivovaru zhodnocen vliv památkové péče a role územního plánování, které mohou v některých případech působit bohužel i kontraproduktivně. S mírnou nadsázkou by se dalo říct, že kvůli existenci památkové ochrany byla budova Branického pivovaru opuštěna a chátrá.

Abstract:

The cultural heritage of the Czech Republic represents outstanding cultural and finacial values. Historical landmarks, monuments and sites hand over the information about our predecessors, about their life style, habits and traditions. This is the way how the cultural heritage builds the connecting links between the past and the present. The preservation of our legacy is being ensured by two Acts. The Act No. 183/2006 Coll., The Planning and Building Code (Building Act), and The Act No. 20/1987 Coll., the State Monument. The purpose of this bachelor's work is to find out the unities, discrepancies and duplicities in these Acts. The aim is to evaluate the legislative background of the cultural heritage preservation. This bachelor's work deals with the views of the culture preservation and landscape planning. The ifluence of the sight preservation and the role of the landscape planning is analysed and evaluated by setting a concrete example of a former brewery in Branik (Prague). This research shows that at some point the excessive preservation could be even harmful.
