Abstract:

Bakalářská práce, jak již název napovídá, se zabývá přestupky a trestnými činy v silniční dopravě. Tyto delikty jsou závažnými problémy, které mají významný dopad na bezpečnost na našich silnicích. Práce definuje pojem přestupek a trestný čin a také tresty, které jsou za ně ukládány. Je důležité pochopit, že přestupek a trestný čin jsou dva odlišné právní pojmy, které mají různé důsledky a tresty. Dále práce popisuje vybrané skutkové podstaty přestupků a trestných činů, které mají nejčastější frekvenci spáchání. To znamená, že se zaměřuje na ty přestupky a trestné činy, které jsou v silniční dopravě nejčastěji spáchány. Popisuje také nejpřísněji trestné přestupky a trestné činy páchané v silniční dopravě. Práce také charakterizuje evidenci trestů a přestupků v centrálních systémech. Tato evidence je klíčová při ukládání trestů. Dalším důležitým aspektem práce je porovnání bodového systému České republiky s bodovým systémem Spolkové republiky Německo a s právní úpravou Slovenské republiky. Toto porovnání nám umožňuje lépe pochopit, jak různé země řeší problém přestupků a trestných činů v silniční dopravě. Na závěr práce analyzuje statistické údaje z bodového systému České republiky. Tato analýza nám poskytuje cenné informace o tom, jak efektivní je náš bodový systém v boji proti přestupkům a trestným činům v silniční dopravě.

Abstract:

The bachelor thesis, as the title suggests, deals with offences and criminal offences in road transport. These offences are serious problems that have a significant impact on the safety of our roads. The thesis defines the concept of offence and crime and also the penalties that are imposed for them. It is important to understand that an offence and a criminal offence are two different legal concepts that have different consequences and penalties. The thesis also describes selected offences of misdemeanours and felonies that have the highest frequency of commission. That is, it focuses on those offences and crimes that are most frequently committed in road traffic. It also describes the most serious offences and crimes committed in road transport. The work also characterises the recording of penalties and offences in central systems. This registration is crucial in the imposition of penalties. Another important aspect of the thesis is the comparison of the point system of the Czech Republic with the point system of the Federal Republic of Germany and with the legislation of the Slovak Republic. This comparison allows us to better understand how different countries deal with the problem of traffic offences and crimes. Finally, the thesis analyses statistical data from the Czech Republic's point system. This analysis provides us with valuable information on how effective our point system is in combating road traffic offences and crimes.
