A Regulation of Pension Funds and Supplementary Pension Insurance

Abstract:

Tato práce si klade za cíl představit jejím čtenářům funkci, postavení a právní rámec penzijního připojištění v České republice (představovaný zákonem č. 42/1994 Sb. o penzijním připojištění se státním příspěvkem a o změnách některých zákonů souvisejících s jeho zavedením) a dále se zaměřuje na změny, které budou do celého systému penzijního zajištění vneseny reformou k datu 1. ledna 2013. Její snahou je seznámit čtenáře se základy fungování penzijních fondů a jejich rolí v systému penzijního zajištění. Současně se práce zabývá vývojem penzijního systému, jakož i některými statistickými parametry dokládajícími postavení penzijních fondů. Kromě samotných dat jsou zkoumány vývojové trendy. Kromě toho docházelo vždy k zohlednění dopadů reformy a postojů české společnosti k ní, když s ohledem na mnohé vznášené připomínky týkající se nemožnosti změny rozhodnutí o vstupu do druhého pilíře, chybějící garance vkladů ze stran státu a poklesu průměrného příjmu hrozí reálné nebezpečí, že reforma bude naprostou většinou občanů odmítnuta.

Abstract:

The aim of this thesis is to introduce its readers the function, position (within the system) and legal framework of the supplementary pension insurance in the Czech Republic (by Czech law No. 42/1994 Coll. on state-contributory supplementary pension insurance and amending certain acts related to its introduction) and furthermore it concentrates on the changes of the entire system introduced by the pension reform effective as of January 01st, 2013. The thesis also tries to make the readers aware of the elementary principles connected with the functioning of the pension funds and their role within the pension scheme. At the same time, the thesis is concerned with the development of the pension system as well as the evaluation of some statistical data illustrating the position of the pension funds. Apart from the data itself, the future trends are being examined. Apart from that the influence of the reforms was taken into consideration together with the overall attitude of the general public, where there is an eminent risk that the reform will be rejected by the vast majority bof the public due to the concerns raised, such as the irreversibility of the decision to enter the second pillar, the lack of state guarantee of the contributions and the decline of the average income.
