Process of re-socialization in prisons in the EU member states

Abstract:

Předkládaná diplomová práce se zabývá problematikou resocializace ve věznicích států Evropské Unie. Podmínky výkonu trestu ? povinnosti, práva, možnosti chování vězňů a jejich extramurálních kontaktů se od sebe liší, ačkoli se všechny vězeňské systémy států Evropy řídí Evropskými vězeňskými pravidly. Rozdílný přístup k vězňům v různých státech Evropské Unie spočívá především v různém pojetí trestní politiky týkající se délky trestu odnětí svobody, materiálním zabezpečení věznic, jiných bezpečnostních opatřeních, přípravou zaměstnanců, odlišnou realizací programů zacházení s vězni, různými možnostmi kontaktů s vnějším světem, různou mírou uplatnění operativních opatření a kontroly dodržování lidských práv vězňů. Zaměstnanci Vězeňské služby ČR ve funkci speciální pedagog s vězněnými cizinci poměrně často zacházejí a považují proto pro svou práci za přínosné, aby měli alespoň rámcovou představu, jak se podmínky věznění u nás liší od podmínek věznění v jiných státech. Mohou se tak vyhnout možným nedorozuměním, které z této neznalosti mohou vyplynout. Pro větší informovanost zaměstnanců Vězeňské služby ČR by bylo vhodné zařadit do vzdělávání na jakékoli úrovni poznatky o vězeňských systémech jiných států, především států Evropské Unie, umožnit zaměstnancům účast na krátkodobých zahraničních stážích, případně v rámci pravidelných instrukčně metodických seminářů zvát hosty z evropských vězeňských služeb pro přímou výměnu zkušeností. Tím by se bezesporu přispělo k prevenci konfliktů s vězněnými cizinci, zvýšení účinnosti jejich programů zacházení a tím i zvýšení efektivity působení trestu odnětí svobody. Tato diplomová práce může být též využita jako studijní materiál a přispět k získání základních informací o vězeňských systémech států Evropské Unie.

Abstract:

The dissertation deals with issues of re-socialization in prisons in the EU member states. Conditions of the imprisonment ? obligations, rights, various possibilities for behaviour of prisoners and extramural contacts ? are different; despite all EU member states follow the European Prison Rules. Different approaches of the EU member states towards prisoners lies especially in different concepts of the criminal policy related to the length of the imprisonment, material conditions in prisons, different security measures, training of the prison staff, different treatment programs, different system of contacts with the outside world, different levels of operational measures and supervision over human rights of prisoners. Employees of the Prison Service of the CR working as special pedagogues are in a relatively frequent contact with incarcerated foreign nationals and from the standpoint of their work they consider as useful to have at least a general idea of differences between our conditions of the imprisonment and conditions in another countries. This way they can avoid possible misunderstandings that may result from such ignorance. To enhance awareness of the employees of the Prison Service of the CR it would be suitable to include information on prison system of the other states, the EU member states in particular, in the educational process on any level and to enable them to attend in short-time scholarships in foreign countries or to invite colleagues from European prison services to give lectures at instructional workshops focused on the direct exchange of experience. This way, without any doubts, prevention of conflicts with incarcerated foreign nationals would be reinforced and effectiveness of the treatment programs would be enhanced, as well as the overall effectiveness of the imprisonment. This dissertation can be used as a study paper and should contribute to the retrieval of fundamental information on prison system of some of the EU member states.
