Předmětem této práce je analýza specifického způsobu uzavírání smluv postupem dle ust. § 275 odst. 4 ObchZ s přihlédnutím k rekodifikaci soukromého práva, tedy postupu kontraktace podle ust. § 1744 NOZ. Práce po vymezení historických předpokladů právních a společenských rozhodných ke vzniku reálné akceptace přechází k podrobnému rozboru ust. § 275 odst. 4 ObchZ. The objective of this thesis is an analysis of the specific way of contracting under Section 275 paragraph 4 of the Czech Commercial Code with regard to the recodification of private law, thus contracting under Section 1744 of the new Civil Code.
