Social aspects influencing granting of custody of an underage child to the father's care.

Abstract:

Bakalářská práce se zabývá problematikou rodiny, rozvodu manželství, úpravou poměrů nezletilého dítěte a také sociálně-patologickými jevy, které ovlivňují svěření nezletilého dítěte do péče otce. Bakalářská práce je rozdělena na teoretickou a praktickou část. V teoretické části jsou charakterizovány typy rodin, ve kterých nezletilé dítě vyrůstá, rozvod rodičů, reakce dítěte na rozvod rodičů, z jakého důvodu dochází k rozvratu manželství, právní úprava manželství i právní úprava ohledně poměrů nezletilého dítěte po rozchodu/rozvodu rodičů. Práce se dále zaměřuje na důležitost role matky i otce ve výchově dítěte, kdy je především kladen důraz na absenci matky při výchově dítěte. Popisuje státní instituce, které pomáhají nefunkčním rodinám při řešení konfliktů a služby, které tyto instituce poskytují. V této práci je dále sledováno, jakým procesem musí nejenom rodiče, ale především nezletilé dítě projít během soudního řízení a jaké to má na dítě dopady.Teoretická část bakalářské práce vychází z literárních zdrojů a je východiskem pro empirickou část. Empirická část bakalářské práce je věnována prezentaci kvantitativně orientovaného výzkumu, který je zacílen na obsahovou analýzu soudních dokumentů týkajících se svěření nezletilého dítěte do péče otce z důvodu výskytu sociálně-patologických jevů u matky dítěte. Empirická část je dále doplněna případovou studií. Cílem této práce je zanalyzovat historický vývoj soudních rozhodnutí za posledních pět let a zjistit faktory, které hrají při rozhodování soudu největší roli.

Abstract:

The bachelor's thesis deals with the topic of family, divorce, regulation of the circumstances of a minor and also with the socially pathological phenomena which affect the decision to give the custody of a child to a father. The bachelor's thesis is divided into theoretical and practical part. The theoretical part characterizes the types of families in which a minor grows up, the divorce of parents, the child's response to the parent's divorce, the reasons for divorce, the legal regulation of marriage and the legal regulation of the circumstances of a minor after a divorce of parents. The thesis further focuses on the importance of the roles of mother and father in the child-raising process, where the main emphasis is placed on the absence of mother in the child-raising process. In the thesis there are described government institutions which help the dysfunctional families to resolve their conflicts and the services which these institutions provide. The thesis also examines the process which have to undergo not only the parents but especially the minor child during the court proceedings and how it affects the child. The theoretical part of this thesis is based on literary sources and creates a base for the empirical part. The empirical part of this bachelor's thesis is devoted to the presentation of quantitatively oriented research which focuses on the content analysis of court documents concerning the custody of a minor child that was given to a father due to the occurrence of socially pathological phenomena in the child's mother. The empirical part is further accompanied by a case study. The aim of this thesis is to analyse the historical development of court decisions over the last five years and to detect the factors that play the most important role in court decisions.
