Sports Arbitration and the Right of Access to Court

Abstract:

Tato práce se zaměřuje na problematiku řešení sporů ve sportu, s důrazem na jejich rozhodování v rámci rozhodčího řízení. Úvodní část práce se zaměřuje na postavení samotného sportu a dále pak na postavení sportovních asociací, zejména na normativní základ, jakož i jejich vnitřní strukturu a pravidla. V další části jsou rozebrány jednotlivé způsoby řešení sporů ve sportu. Poté je prostor věnován vymezení práva na přístup k soudu, jež představuje jeden ze základních kamenů moderního právního státu. Stěžejní část práce je zaměřena k řešení otázky, zda je právo na přístup k soudu v rámci sportu dostatečně zaručeno, přičemž je poukazováno především na závěry plynoucí z relevantní judikatury. V závěru práce je k dané problematice uvedena úvaha samotného autora.

Abstract:

This thesis focuses on the issue of dispute resolution in sport, with an emphasis on their decision-making within arbitration. The introductory part of the thesis focuses on the position of sport itself and then on the position of sports associations, especially on the normative basis as well as their internal structure and rules. The next part discusses the various ways of resolving disputes in sport. Then the space is devoted to defining the right of access to court, which is one of the cornerstones of the modern rule of law. The main part of the thesis is focused on solving the question of whether the right of access to the court is sufficiently guaranteed in sport, while pointing out the conclusions arising from the relevant case law. while pointing out the various currents of opinion of both experts o and relevant case law. At the end of the thesis is the author's own reflection on the topic.
