Problems of European Arrest Warrant from the View of the Authorities Operating in the Criminal Procedure

Abstract:

Téma diplomové práce pojednává o problematice jednoho relativně nového právního nástroje mezinárodní justiční spolupráce v trestních věcech – tzv. evropského zatýkacího rozkazu (dále jen „EZR“) a s tím souvisejícího procesu předávání hledaných osob mezi členskými státy Evropské unie. Práce je rozdělena do sedmi hlavních kapitol. V úvodu je představena cesta, která vedla ke vzniku EZR. Následující kapitoly pojednávají o implementaci Rámcového rozhodnutí Rady ze dne 13. června 2002, č. 2002/584/SVV, o evropském zatýkacím rozkazu a postupech předávání mezi jednotlivými členskými státy do právního řádu České republiky a o EZR jako takovém. Jádro práce tvoří čtvrtá a pátá kapitola, ve kterých je podrobně rozebrán předávací proces, a to nejprve v roli České republiky jako státu vystavujícího EZR, následně pak v roli České republiky jako státu vykonávajícího EZR. V závěru práce popisuji průvoz vyžádané osoby mezi dvěma členskými státy přes území České republiky a přináším statistické poznatky z praxe aplikace EZR. Cílem diplomové práce je přinést ucelený pohled na problematiku předávání osob na základě EZR, zhodnotit českou právní úpravu obsaženou v trestním řádu a vnitřních předpisech orgánů činných v trestním řízení, upozornit na její nedostatky a předložit náměty de lege ferenda.

Abstract:

Thesis deals with the problems of a relatively new legal instruments of international judicial cooperation in criminal matters - so-called European arrest warrant (EAW) and the related process of transfer of wanted persons between Member States of the European Union. The work is divided into seven main chapters. The introduction presents a path that led to the emergence of an EAW. Subsequent chapters deal with the implementation of Council Framework Decision of 13 June 2002, No. 2002/584/JHA on the European arrest warrant and surrender procedures between Member States to the Czech law and shall be entered as such. The core work consists of fourth and fifth chapter, which is analyzed in detail the transfer process, initially in the role of the Czech Republic as a State issuing the EAW, and subsequently the role of the Czech Republic as a state executing the EAW. In conclusion of the master thesis I describe the transit of the person sought between two Member States through the territory of the Czech Republic for the surrender and bring statistical data from the practice of application of the European arrest warrant. The purpose of this master thesis is to provide a comprehensive view on the surrender procedures of person on the basis of a European arrest warrant, to assess the Czech legal framework contained in the Penal Code and the regulations of internal law enforcement proceedings, to highlight deficiencies and to submit proposals for their solution.
