Mental Disorder and its Criminal Law Contexts

Abstract:

Tato diplomová práce se zabývá trestněprávními souvislostmi duševní poruchy. Snahou práce je především podat ucelený přehled všech trestněprávních institutů, které s duševní poruchou souvisí. Nejdůležitější část práce je věnována pojetí duševní poruchy v platné právní úpravě, kdy je zde poměrně podrobně rozebráno ustanovení § 123 zákona č. 40/2009 Sb., trestního zákoníku, které nově zavádí legální definici duševní poruchy. Pozornost je dále věnovaná hmotně právním a procesně právním aspektům duševní poruchy. V práci však nechybí ani historický exkurz a opominuta není ani problematika znaleckého posuzování duševní poruchy. Obsaženo je také srovnání české a německé trestněprávní úpravy duševní poruchy se zaměřením na definici duševní poruchy, nepříčetnost, zmenšenou příčetnost a ochranná opatření. V závěru jsou nastíněny návrhy de lege ferenda.

Abstract:

This master thesis deals with criminal relations to a mental disorder. The aim of the thesis is to provide a comprehensive summary of all criminal fields connected to a mental disorder. The most important part of the work is devoted to the concept of mental disorder in positive law with a detailed analysis of provision § 123 of Penal Code 40/2009 Sb. that introduces the legal definition of mental disorder. It further explores a mental disorder in relation to substantive and procedural law. The thesis also includes a historical insight into the topic and covers the issue of mental disorder expert evidence. Additionally it compares the Czech and German criminal law with the focus on definition of mental disorder, insanity, diminished sanity and protective measures. In conclusion, de lege ferenda proposals are outlined.
