Circumstances excluding illegality

Abstract:

Tato bakalářská práce pojednává o problematice okolností vylučujících protiprávnost, a to jak obecně z pohledu trestní odpovědnosti, tak především z pohledu konkrétních okolností vylučujících protiprávnost, o kterých je v této práci podrobně pojednáno. Úvod je zprvu zaměřen na trestní odpovědnost, která je důležitá pro samotnou problematiku okolností vylučujících protiprávnost. Dále je pojednáno o konkrétních okolnostech vylučujících protiprávnost jak z pohledu teorie, tak z pohledu praxe. Meritem práce je pak především analýza nutné obrany v současné právní úpravě, komparace se zahraniční právní úpravou, ale také srovnání s krajní nouzí. Závěrem je v práci představen názor autora na současnou podobu nutné obrany.

Abstract:

This bachelor's thesis deals with the issue of circumstances excluding illegality, both generally from the point of view of criminal liability and, above all, from the point of view of the specific circumstances excluding illegality discussed in detail in this work. The introduction focuses at first on criminal liability, which is important for the very issue of circumstances excluding illegality. It then discusses the specific circumstances which preclude unlawfulness both from the point of view of theory and from the point of view of practice. The merit of then work, then, is above all an analysis of the necessary self-defence in the current legislation, a comparison with the foreign legislation, but also a comparison with the extreme necessity. Finally, in the work of imagining the author's view of the present form of necessary defence.
