V mezích aktuální právní úpravy je řízení o vyslovení neplatnosti rozhodnutí orgánu spolku projednáváno v nesporném režimu. Je však takové legislativního uchopení s ohledem na skutečnou povahu řízení vhodné? V doktríně se na tuto otázku nenabízí jednoznačná odpověď. The civil proceedings in cases of action against corporate decision is tried in non-contentious proceedings under the current legal regulation. Is such an approach appropriate considering the actual nature of the proceedings? The doctrine does not offer a clear answer to this question.
