Determination and Negation of Parenthood

Abstract:

Cílem mé rigorózní práce bylo podat co možná nejkomplexnější výklad právní problematiky určování a popírání rodičovství ve srovnání historickém a navrhovaném v rámci rekodifikace občanského zákoníku. V rámci této rigorózní práce jsem problematiku určování a popírání rodičovství rozebrala z hlediska hmotného práva a procesního práva. Zabývala jsem se právní úpravou České republiky, ale také Úmluvou o právech dítěte a příslušnou judikaturou Evropského soudu pro lidská práva ve Štrasburku. Jednu z částí práce jsem zaměřila také na rozdílnou právní úpravu Slovenské republiky. Pokrok lékařské vědy, biologie a genetiky, ale také změny v životním stylu a rozdílné postavení institutu rodiny v rámci hodnotového žebříčku nemalou měrou ovlivnily pojetí právního určení rodičovství. Kriticky jsem analyzovala současnou právní úpravu, pokusila se přitom odkázat na její nedostatky, navrhnout jejich právní řešení a přispět k tomu, aby právní úprava určení a popření rodičovství byla především v zájmu dětí. V práci jsem se mimo jiné věnovala statistickému zhodnocení projednávaných návrhů o určení rodičovství u Okresního soudu v Jablonci nad Nisou v období od 1. 1. 2003 do 10. 6. 2008.

Abstract:

The aim of my rigorous work was to give a comprehensive interpretation of the legal problems of determination and negation of parenthood in the historical comperation and suggested in a recodificated framework of Civil Code. This work deals with the legal regulation of determination and negation of parentage according substantive law and procedural law. This work deals with the legal regulation of the Czech Replic, but also with the Convention on the protection of the rights of children and competent judical decisions of European Court of Human Rights in Strasbourg. Then there is our legal regulation in the given area with legal regulation of the Slovak Republic. Progress of medicine, biology and genetics, but also lifestyle ganges and different position of the family institute in the value ranking changes influenced the conception of a legal determination of parenthood largely. In my work I analysed the topic with ciritical view of contemporary legal regulation. I tried to refer to shortcomings and on the other side to suggest some legal solutions and contribute to that the legal regulation of determination and negation of parentage would be mainly in the interest of the children. In my work I gave an attention to the statistical improvement of tried suggestions about parenthood´s determination by District Court in Jablonec nad Nisou from 1. January 2003 till 10. June 2008.
