Designs Dictated by their Technical Function and Designs of Interconnections

Abstract:

Cílem této práce s názvem: „Průmyslové vzory a technické předurčení“ je vyložit obsah a funkci pojmu „technické předurčení“ ve vztahu k právní úpravě průmyslových vzorů. Předmětem zkoumání jsou zápisné a judikatorní požadavky ochrany zapsaných průmyslových vzorů v české a unijní úpravě. Prostor je věnován analýze forem technického předurčení a jejich vlivu na zápisnou způsobilost průmyslových vzorů. Kromě teoretické analýzy jsou v práci představeny vybraná rozhodnutí soudních a správních orgánů ČR a EU.

Abstract:

The main objective of this thesis named: „Designs Dictated by their Technical Function and Designs of Interconnections“ is to explain the meaning and purpose of these two legal terms in connection to industrial design law. Therefore, the thesis is focused on analysing the legal and judicial registration criteria for registered designs both in Czech and European law. It concerns the definition of forms of technical constraints and their influence to registrability of the design. It also introduces selected judicial decisions of courts and administrative agencies in Czech Republic and European Union.
