The issue of humanitarian intervention

Abstract:

Užití vojenské humanitární intervence za účelem ochrany lidských práv je v mezinárodních vztazích často diskutovaným tématem, protože její koncept nemá jasné zakotvení a vymezení v mezinárodním humanitárním právu. Základním sporem v debatách o intervenci je nejednoznačnost právních zásad. Na jedné straně se státy zavázaly k ochraně lidských práv prostřednictvím lidsko-právních mezinárodních a regionálních smluv a na straně druhé se státy zavázaly akceptovat tradiční pojetí bezpečnosti, které je neoddělitelně spjato se zásadami státní svrchovanosti a nevměšování se do vnitřních záležitostí státu. Někteří považují porušování lidských práv za dostatečný důvod k použití ozbrojené síly, jiní takovou intervenci pokládají za zcela protiprávní čin, který je v rozporu se základními zásadami, na kterých je postaveno moderní psané mezinárodní právo. Tato bakalářská práce se zabývá argumentací humanitárních intervencí v Kosovu v roce 1999 a Libyi v roce 2011 ze strany stálých členů Rady bezpečnosti OSN. Práce se také zabývá argumentací případné humanitární intervence do Sýrie, ve které probíhá v současné době občanská válka. Jednání o humanitární intervenci v Sýrii již proběhlo, proto práce zkoumá, jaké argumenty jednotlivé velmoci používaly. Práce zároveň hodnotí jednotlivé argumenty z právního hlediska. Některé argumentace ze strany některých států se měnily a některé zůstaly konstantní. Bakalářská práce se zaměřuje i na proměnu použitých argumentů.

Abstract:

The idea of Humanitarian Intervention is not as clear as IT seems. There are some states which criticize the use of force and other states which agree with the use of force for humanitarian reasons. The main problem of Humanitarian Intervention comes from the traditional tension between protection obligations defined in international human rights law and international humanitarian law, and traditional perceptions of security which are linked to the principles of state sovereignty and non-interference. This thesis deals with the arguments for and against humanitarian interventions in Kosovo (1999) and Libya (2011) presented by the permanent members of the UN Security Council. Also focuses on potential humanitarian intervention in Syria where a civil war takes place currently. UN Security Council discussed the potential intervention in Syria therefore the Bachelor thesis examines what arguments were used by powerful states to justify a potential intervention to Syria. This thesis evaluates various arguments from the legal point of view. Some of the arguments made by some states have changed and some have remained constant. This thesis focuses on these variable arguments, too.
