Abstract:

Práce je věnována eknomické kriminalitě a postojům veřejnosti k otázkám hospodářské kriminality. Cílem mé práce je popsat a shrnout existující, převážně teoretické poznatky, týkající se metodiky vyšetřování finanční kriminality, upozornit na některé nedostatky a případně navrhnout řešení na základě analýzy finanční kriminality v praktické části mé práce

Abstract:

The financial criminality is one of the most terrifying phenomenoms in the transforming economics of the Czech Republic. It had started with a number of colossal movements of property since the Velvet revolution. The numbers of the cases identified have been increasing as well as the numbers of prosecuted and convicted persons. In parallel, the volume of financial harms has also been rising. At the same time the importance of the organized forms of criminality also increases which both makes the production of the crime evidence more difficult. A similar increase has been observed for the criminal activities situated inside the sphere of banking. Financial criminality is mostly appeared inside the sphere of capital market, stockbrokerage, insurance industry and public budgets too. One of the important tools protecting the country economics is the Law 61/1996 Sb., that concerns the measures rulling out legalization of proceeds obtained by criminal activities. Its existence, among others, opens a space for looking up and prosecuting both the cases that seek to legalize such profits and other cases of the financial criminality. Another important institute is the seizure of illegal proceeds that are on a bank account that together with the previously completed and newly defined provisions of the Criminal Law and in the context of the last amendment of the Law concerning the Police of the Czech Republic improves the basic body of legislation that enables us to act against the organized forms of financial criminality.
