The legal status of the child as a particularly vulnerable victim in criminal proceedings with a focus on problematic aspects of compensation for non-pecuniary damage in the case of sexually motivated crimes

Abstract:

Tato práce se zabývá problematikou právního postavení dětí jako zvlášť zranitelných obětí sexuálně motivovaných trestných činů v rámci trestního řízení a přináší odpověď na otázku, zda je platná právní úprava způsobilá přispět k náhradě jejich nemajetkové újmy, ať už prostřednictvím pravomocného trestního rozsudku, či peněžité pomoci poskytované státem, a zda napomáhá k reálnému vymožení přiznaných adhezních nároků. Práce je systematicky rozčleněna do celkem desíti kapitol, v rámci kterých je popisována a kriticky analyzována právní úprava dotýkající se práv nezletilých dětí, zejména při zvláštní pozornosti věnované adheznímu řízení s důrazem na odškodňování způsobené nemajetkové újmy, a to včetně návrhů de lege ferenda v případě zjištěných nedostatků. Relevantní instituty pak jsou v závěru této práce podrobeny komparativnímu srovnání s polskou právní úpravou.

Abstract:

This thesis deals with the issue of the legal status of children as particularly vulnerable victims of sexually motivated crimes within the boundaries of the criminal proceedings and provides an answer to the question of whether the valid legislation is capable of contributing to the compensation of non-pecuniary damage to those victims, either through a final criminal judgment or through the financial support for victims provided by the state, and whether the valid legislation actually helps to enforce the entitled claim through adhesion procedure. The thesis is systematically divided into a total of ten chapters, within which the legislation affecting the rights of minors is described and critically analyzed, in particular with special attention paid to the adhesion procedure with an emphasis on compensation for non-pecuniary damage caused by sexually motivated crimes, including De Lege Ferenda proposals whenever any deficiencies are identified. Finally, all the main relevant thesis subjects are further compared with Polish legislation.
