The Position of the Executive Power in the Political System of the Russian Federation

Abstract:

Diplomová práce popisuje pozici výkonné moci v politickém systému Ruské federace (RF) od počátku devadesátých let až do současnosti. Ruská exekutiva je nadále silně ovlivněna konfliktem mezi prezidentem Jelcinem a Sjezdem lidových poslanců. Aby nedošlo v budoucnosti k podobné krizi, která vyústila v "podzimní válku", Jelcin prosadil pomocí všelidového hlasování na konci roku 1993 novou Ústavu RF. Tato konstituce posílila výkonnou moc prezidenta na úkor vlády a parlamentu. Suverénní postavení prezidentské (exekutivní) moci lze dokumentovat na sporech se Státní dumou v druhé polovině devadesátých let. Za prezidenta Putina došlo k ještě většímu posílení prezidentské výkonné moci na úkor ostatních státních institucí. Putinovi se podařilo vytvořit "poslušný" parlament díky prokremelským stranám (Jednota> Jednotné Rusko a Spravedlivé Rusko) a reformám Rady federace. Třetí prezident Ruské federace Medveděv přebral po Putinovi post prezidenta, který se z pozice dnešní reálné politiky jeví jako nejslabší za celou novodobou historii Ruské federace v kontrastu s postem předsedy vlády, jejž zastává u ruských občanů oblíbenější Putin. Pojednání o formě vlády musíme rozdělit na dvě roviny, které se od sebe výrazně liší. V rovině ústavně právní je určení formy vlády snazší zejména kvůli rigidnosti Ústavy RF. V ústavně právní rovině se nejvíce Ruská federace přibližuje superprezidentskému režimu. Určení formy vlády je těžší v rovině (de facto) kvůli dynamice politiky. Jelcinovo období odpovídá superprezidentskému režimu s prvky autoritářství. Za Putina můžeme Ruskou federaci definovat jako neliberální demokracii se božštělým vůdcem, který upřednostňuje termín "suverénní demokracie". Pokud jde o formu vlády nového prezidenta Medveděva, je obtížné v tak krátké době jeho prezidentování určit relevantní závěr. V současné době povaha výkonné moci stále více odpovídá semiprezidentské formě vlády.

Abstract:

This study describes the position of executive power in the political system of the Russian Federation (RF) since the early nineties to the present. Russian executive branch is still strongly influenced by the conflict between President Yeltsin and the Congress of People's Deputies (the part of the Government). In order to avoid future similar crisis, which resulted in the ?Autumn war?, Yeltsin pushed through the popular vote in late 1993 ? a new RF Constitution, which has strengthened the executive power of the President at the expense of the Government and Parliament. Sovereign status of the presidential (executive) power can be documented on the disputes with the State Duma on rapid replacement of prime ministers during the second term of Yeltsin presidency. Under President Putin even greater strengthening of presidential executive power at the expense of other state institutions took place. Putin has managed to create the ?obedient? Parliament thanks to for-Kreml´s Parties (Unity > United Russia and A Just Russia) and reforms of the Federation Council. Third President of the RF Medvedev, who took over the post of president after Putin, seems to be - in contrast with the post of prime minister held by more popular Putin - the weakest one in the modern Russian history. The position of executive power in the Russian political system can be also derived from the characteristic forms of governance. Taking into account findings presented in the text, we shall see the government from two points of view two which are significantly different from each other. At the level of constitutional law it is easier to determine the form of government mainly because of the rigidity of the RF Constitution. By definition, constitutional law in Russian political system is the most close to super-presidential regime. In reality, to categorize the Russin governmental system is rather difficult because of the flexibility of polical changes. We shall simplify the typology of governance with regard to individual presidents. Yeltsin's term might be a very good example of super-presidentail regime with elements of authoritarianism. Even more striking accumulation of power can be seen during Putin's presidency. Both Putin's terms can now be defined as an illiberal democracy with godlike leader, who prefers to use the term ?sovereign democracy?. As for the form of government of the new president Medvedev, it is difficult in such a short time under its presidency to come to final conclusions. At present, the nature of the exercise of executive power more and more fits into the definition of semi-presidential form of government.
