Abstract:

Předkládaná bakalářská práce na téma „ Právní kultury a velké právní systémy“ seznámí čtenáře s historickým vývojem právních systémů a právních kultur významných států světa s ohledem na státní ústavnost a právní podstatu státu. Práce je rozdělena do několika kapitol dle daných témat. Po úvodu se budu věnovat právně teoretickým pojmům, stěžejním pro tuto práci. Dále v bakalářské práci zachytím charakter jednotlivých právních systémů nejen z hlediska nejdůležitějšího kritéria – pramenů práva, ale i z hlediska vzájemných vztahů a charakteristických znaků angloamerického a kontinentálního práva, vše v kontextu právní teorie. V závěru uvádím shrnutí poznávání a rozlišování právních kultur za pomocí komparatistické metody uplatňované jako srovnávací právní věda, která hraje důležitou roli v oblasti právní teorie.

Abstract:

The aim of my Bachelor’s thesis titled ‘The legal cultures and major legal systems’ is to inform the reader about historical development of legal systems and legal cultures of influential countries with regards to state constitutionality and the legal nature of a state. The thesis is divided into a number of chapters according to the chosen topics. Following the introduction I will focus on law terminology, which is crucial for this study. I will continue with characterizing certain legal systems - not only from the view of the most important criterion, which is the origin of law, but I will also focus on the interaction and parallels between Anglo American and continental law in context of the theory of law. In the conclusion, I will summarize the recognition and differentiation of legal cultures using the methods of comparative law, which plays an important role in the theory of law.
