Presidential Powers

Abstract:

Tato diplomová práce se zabývá pravomocemi prezidenta České republiky a jeho postavením. Hlouběji je pojednáno o jmenování do státních funkcí, které činí hlava státu a poukázáno na dosavadní problémy v politické praxi. Cílem je posouzení, zda prezident musí navrhované jmenování uskutečnit a je-li soudně přezkoumatelné, když jmenování odmítne učinit. V práci je také zmíněna odpovědnost hlavy státu za právní akty. Závěrečná kapitola, jejíž součástí je úprava de lege ferenda, posuzuje, zda jsou prezidentské pravomoci dostatečné nebo zda by se měly zúžit či naopak rozšířit.

Abstract:

This diploma thesis focuses on the powers of the president of the Czech Republic and his legal standing. In depth an assessment is conducted analyzing the powers of the head of state for appointment to the office under his responsibility and the problems resulting from the political practice. The aim of that assessment is to understand whether the president has a duty to appoint such a nominated person and in case he refuses to do so if such a decision is judicially reviewable. A special focus is given to the head of state’s responsibility for legal acts. The final chapter, which includes a de lege ferenda regulation, assesses whether the presidential powers are sufficient or whether they should be narrowed or increased.
