Ve své diplomové práci jsem nejprve pojednala o samotné generální klauzuli nekalé soutěže ve vztahu k pojmenovaným skutkovým podstatám nekalé soutěže. Poté jsem se zaměřila na tzv. soudcovské neboli nepojmenované skutkové podstaty nekalé soutěže. Snažila jsem se na základě judikatury a odborné literatury vyčlenit ty podstaty, které jsou již právem tolerované. V závěru jsem uvedla významné hledisko …more
Abstract:
I wrote about the General Clause of the unfair competition in accordance with the special clauses of the General Clause in my thesis. Then I tried to focuse on the innominate unfair business practices of the General Clause. I stated very important the aspect of the average consumer in the end.
