Abstract:

Práce je zaměřena na zkoumání vybraných aspektů lidské reprodukce z hlediska bioetiky, konkrétně asistované reprodukce a umělého ukončení těhotenství. Pracuje tedy nejen s perspektivou právní, ale i s pohledem etiky a lékařství. Mapuje situaci v evropském i vnitrostátním prostoru. Za tímto cílem práce analyzuje závazky plynoucí z mezinárodního práva a konsekventně vnitrostátní regulaci, a provádí komparaci s vybranými zahraničními právními úpravami. Hodnocení stavu relevantní vnitrostátní legislativy je prováděno se zohledněním systémových souvislostí. Zkoumány jsou konkrétní problémy a možnosti jejich řešení za současného právního stavu, s přihlédnutím ke změnám, jež přináší reforma soukromého práva. Závěrem jsou formulována konkrétní doporučení de lege ferenda.

Abstract:

The objective of this thesis is to evaluate specific health care legislation related to the issue of reproduction in the Czech Republic and its evolution in time. The question was asked whether in its current form, the Czech legislation maintains to reflect properly challenges resulting from advances in biomedicine, with special emphasis on their ethical aspects. In a broader context, the aim of this work was to compare the Czech legislation with other legislation systems and international legal obligations, especially in the European context. Two interrelated areas were explored for the purposes of this thesis: assisted reproduction and medically induced abortions. Both of them are treated as two sides of the same story, as two different ways of manifesting individual freedom and autonomy. So far, these issues have not been sufficiently discussed in the Czech Republic. Consequently, only limited publishing and legal activities can be identified in this area. The thesis raises particular problems that may be challenged within national legislation. Throughout resolving them, recommendations pro future are being made.
