Abstract:

Diplomová práca je rozdelená na tri kapitoly, ktoré sa navzájom dopĺňajú. V prvej kapitole je charakterizované, čo robí Európu Európou a Európanov Európanmi, a aké historické či mentálne rysy sú toho príčinou. Tieto európske rysy sú opísané prostredníctvom komparácie Európy so Spojenými štátmi americkými. V druhej kapitole je opísaný historický vývoj, ktorý viedol k vytvoreniu Európskej únie a európskeho občianstva. Začal som pri opise občianstva prvého európskeho ,,superštátu“, teda Rímskej ríše. To kvôli tomu, že práve v Rímskej ríši a rímskom práve je možné nájsť predobraz dnešného európskeho práva a z neho plynúceho občianstva. Pokračoval som opísaním vzniku európskych národných štátov, pretože práve z nich sa neskôr vyvinul európsky nadnárodný štát. Prirodzene, venoval som sa aj vývoju západnej Európy a európskeho občianstva po druhej svetovej vojne. Pokúsil som sa vystihnúť míľniky a dokumenty, ktoré pre boli pre vývin európskeho občianstva do jeho súčasnej podoby najdôležitejšie. A tiež jeho perspektívy do budúcnosti, predovšetkým v súvislosti s plánovaným prijatím Európskej ústavnej zmluvy. V tretej kapitole som charakterizoval obsah európskeho občianstva a jednotlivé práva z neho plynúce.

Abstract:

Contract for Establishing of the European Community in it's articles 17-22 constitute Citinzenship of European Union. Citizenship of European Union provides several rights to European citizens. These rights do not displace citizenship rights, that allow individual member states of European Union to their citizens. They stands alongside by rights provided by individual european Member states to their citizens and give to Europeans rights, that they can use for their good. It is the third chapter of my graduation theses, that deals with those rights. I described especially the right of free movement and residence, because this right is most common among them all. In the first chapter of my study, I described the term of European citizenship. Characteristics of Europe and Europeans are based upon comparison with USA and Americans. The biggest emphasis was put of course on the history and evolution of European union and the European citizenship. In this chapter I described the most important milestones of european integration, so as the documents of european citizenship. The citizens of European union member states might often hear or read about the deepening of the european integration, about the efforts to ratify european constitution, and about various corporate European union matters.
