International economic crime on the territory of European Union

Abstract:

This bachelor thesis deals with the economic crime committed within the territory of the European Union. The first chapter focuses on the explanation of crime committed in the economy, as well as the issue of illegal operation of the financial system, new criminal trends in economic crime and the explanations of the principle of ultima ratio. The second chapter discusses the historical development of economic crime since the fall of socialism through the reform, to influence the dynamics of economic crime, the devaluation of the crown. The third chapter analyzes the states with the largest economic crime in the European Union in terms of value added tax and tax fraud as well as the very issue of value added tax and proposal of measures to combat tax fraud targeted at value-added tax and escape. The fourth chapter focuses on the most economical ways of committing crimes in the territory of the European Union and in particular to commit cybercrime and economic crime using the Internet as well as evasion of customs. The fifth chapter is a last resort chapter deals with law enforcement proceedings, which are referred to the commercial, banking and tax secrecy but also the process of proving a serious economic crime and the auditor in the process of preventing and prosecuting economic crime

Abstract:

Bakalárska práca sa zaoberá ekonomickou trestnou činnosťou páchanou na území štátov Európskej únie. Prvá kapitola je zameraná na objasnenie pojmu kriminalita páchaná v ekonomike, ako aj na problematiku fungovania nelegálneho finančného systému, nových trestnoprávnych trendov v hospodárskej kriminalite a vysvetlenia princípu ultima ratio. Druhá kapitola rozoberá historický vývoj ekonomickej trestnej činnosti, od pádu socializmu cez jej reformu, až po ovplyvnenie dynamiky ekonomickej kriminality po devalvácii koruny. Tretia kapitola analyzuje štáty s najväčšou ekonomickou trestnou činnosťou v Európskej únii čo sa týka dane z pridanej hodnoty a daňových podvodov ako aj samotnej problematiky dane z pridanej hodnoty a návrhu opatrení na boj proti daňovým podvodom zameraných na daň z pridanej hodnoty a ich únik. Štvrtá kapitola je zameraná na najčastejšie spôsoby páchania ekonomickej trestnej činnosti na území štátov Európskej únie a to najmä na počítačovú kriminalitu a páchanie ekonomickej trestnej činnosti za pomoci internetu ale aj daňových únikov v oblasti colníctva. Piata kapitola je poslednou riešenou kapitolou a zaoberá sa orgánmi činnými v trestnom konaní pričom sú spomenuté aj obchodné, bankové, daňové tajomstvo ale aj proces dokazovania závažnej ekonomickej trestnej činnosti a audítor v procese predchádzania a trestného stíhania ekonomickej trestnej činnosti.
