Abstract:

Tato diplomová práce představuje rozsáhlý výzkum zaměřený na téma alternativních trestů, a to z perspektivy pracovníků probační a mediační služby v České republice. Hlavním záměrem této práce je poskytnout hlubší pohled na efektivitu a vnímání alternativních trestů v rámci specifického kontextu českého právního systému. Výzkumná metodologie je koncipována jako komplexní sběr dat, přičemž klíčovým nástrojem je dotazníkové šetření distribuované mezi pracovníky probační a mediační služby. Analýza se zaměřuje na podrobné hodnocení postojů k alternativním trestům, provádí komparativní studii jejich účinnosti ve srovnání s tradičními formami trestů a identifikuje potenciální bariéry v administrativním procesu. Tímto rozsáhlým výzkumem práce usiluje nejen poskytnout detailní pohled na perspektivu a zkušenost pracovníků, ale také přispět k hlubšímu pochopení tématu alternativních trestů v českém kontextu. Očekávané výsledky mají ambici poskytnout komplexní vhled do efektivity těchto trestů a zároveň sloužit jako relevantní zdroj pro diskuse o optimálním využití alternativních trestů v českém trestním systému. Celkově lze konstatovat, že tato rozsáhlá analýza a výzkum má za cíl přinést nejen osvětlení nuancí spojených s alternativními tresty, ale též podporovat informovaný a hluboký dialog v rámci jejich optimální integrace do českého právního a trestního prostředí.

Abstract:

This master's thesis represents an extensive research endeavor focusing on the topic of alternative sanctions, specifically from the viewpoint of probation and mediation service professionals in the Czech Republic. The primary aim of this work is to provide a comprehensive understanding of the effectiveness and perception of alternative sanctions within the specific context of the Czech legal system. The research methodology is designed as a comprehensive data collection process, utilizing a questionnaire survey distributed among probation and mediation service professionals. The analysis focuses on a detailed evaluation of attitudes towards alternative sanctions, conducts a comparative study of their effectiveness compared to traditional forms of penalties, and identifies potential barriers within the administrative process. Through this extensive research, the thesis seeks not only to offer an in-depth perspective on the views and experiences of professionals but also to contribute to a deeper comprehension of the topic of alternative sanctions in the Czech context. The anticipated results aim to provide a nuanced insight into the effectiveness of these sanctions and serve as a valuable resource for discussions on the optimal utilization of alternative sanctions within the Czech criminal justice system. In conclusion, this comprehensive analysis and research endeavor aspire not only to illuminate the nuances associated with alternative sanctions but also to facilitate an informed and profound dialogue regarding their optimal integration into the Czech legal and penal landscape.
