International Human Rights Commitments: Adoption Process and its Motivations - Case of Slovakia

Abstract:

The thesis deals with question of international commitment making. The study focuses on adoption process of international human rights commitments and investigates its motivations. The matter of the analysis is the individual complaint procedures under the main United Nations human rights treaties, process of its acceptance and its underlying motivations. Submitted study is a case study, concerning with the case of Slovakia and covering time span from its creation at the beginning of 1993 to 2014, when the last treaty was successfully adopted. The study uncovers reasons for international human rights commitment adoption and answers the question why states commit themselves.

Abstract:

Témou práce je problematika medzinárodného zaväzovania sa štátov. Práca sa zameriava na proces prijímania medzinárodných ľudskoprávnych záväzkov a skúma jeho motivácie. Predmetom analýzy je mechanizmus individuálnej sťažnosti v rámci takzvaných hlavných ľudskoprávnych zmlúv OSN, proces ich prijímania a motivácie, ktoré ho určovali. Predkladaná analýza je prípadovou štúdiou Slovenskej republiky, a to v čase od jej vzniku v roku 1993 do roku 2014, kedy došlo k poslednej úspešnej ratifikácii s ohľadom na vybrané zmluvy. Práca odkrýva dôvody vedúce k prijatiu medzinárodných ľudskoprávnych záväzkov a odpovedá na otázku, prečo sa štáty zaväzujú.
